General Terms and Conditions of Sale

These General Terms and Conditions of Sale (“GTCS”) govern the reservations and stays offered by COSICASA SARL, operator of Les Terrasses de Ruppione, for the seasonal rental of villas located in Corsica, France.

Any reservation implies full and unconditional acceptance of these Terms and Conditions.

2. Purpose

These Terms and Conditions define the booking, payment and stay conditions applicable to the seasonal rental of villas operated by Les Terrasses de Ruppione.

3. Reservations

A reservation becomes firm and binding upon:

  • acceptance of the quotation or rental offer;
  • receipt of the required deposit payment;
  • written confirmation sent to the guest.

The owner reserves the right to refuse any reservation without being required to provide justification.

4. Rates and Prices

Prices are stated in euros (€) and include all applicable taxes, excluding the tourist tax where applicable.

The tourist tax is collected in accordance with the regulations of the Corsican Territorial Authority (“Collectivité de Corse”). The amount is calculated according to the rate in force at the date of the stay and is displayed separately during the booking process.

Prices include, in particular:

  • the rental of the reserved villa;
  • access to the facilities and amenities described in the listing;
  • use of the private heated swimming pools during the operating season;
  • standard consumption of water, electricity and internet access;
  • household linen and equipment described on the website.

The applicable prices are those displayed at the time of booking.

Reservations made through third-party platforms (including Booking.com, Airbnb, Abritel/HomeAway, or others) remain subject to these Terms and Conditions, without prejudice to any specific conditions imposed by such platforms.

5. Payment Terms

Unless otherwise specified at the time of booking:

  • a deposit of 30% of the total booking amount is required to confirm the reservation;
  • the balance must be paid no later than 7 days prior to arrival.

For bookings made less than 14 days before arrival, full payment is required immediately.

Failure to pay within the specified time limits may result in cancellation of the reservation.

6. Security Deposit

A security deposit equal to 25% of the total booking amount is required.

The deposit may be pre-authorized on a credit card or paid according to the arrangements communicated prior to arrival.

The security deposit covers, in particular:

  • damage caused to the buildings, swimming pools, terraces, equipment or furnishings;
  • restoration costs resulting from abnormal or improper use of the property;
  • additional cleaning costs required after departure.

Any damage identified may result in a partial or total deduction from the security deposit, supported by appropriate evidence and documentation.

7. Cancellation Policy

Cancellation by the Guest

The following cancellation fees shall apply:

  • More than 60 days before arrival: full refund of amounts paid, excluding any banking or transaction fees;
  • Between 30 and 60 days before arrival: 50% of amounts paid will be retained;
  • Less than 30 days before arrival: 100% of amounts paid will be retained.

All cancellations must be notified in writing.

Cancellation by the Owner

In the exceptional event that the reserved accommodation cannot be provided, the owner shall offer:

  • equivalent accommodation where possible; or
  • a full refund of all amounts paid.

No additional compensation may be claimed.

8. Check-In and Check-Out

Unless otherwise agreed:

  • Check-in: from 4:00 PM;
  • Check-out: before 10:00 AM.

Guests must inform the owner of any late arrival.

9. Occupancy and Use of Facilities

The villas at Les Terrasses de Ruppione are luxury accommodations intended exclusively for temporary residential use.

Facilities available to guests include:

  • private heated swimming pools;
  • furnished terraces;
  • premium household appliances;
  • outdoor furniture;
  • Wi-Fi internet access;
  • comfort amenities described in the property listing.

Use of the swimming pools is entirely at the occupants’ own risk.

Children must remain under the continuous supervision of a responsible adult.

The owner shall not be held liable for accidents resulting from improper use of the swimming pools or facilities provided.

Guests undertake to comply with all safety instructions displayed within the villa.

10. Guest Liability

Guests are responsible for any damage caused by themselves or by persons accompanying them.

Guests undertake to maintain the property in a reasonable condition throughout their stay.

Guests must hold valid personal liability insurance covering their stay.

11. Owner Liability

Photographs, descriptions, plans and visual materials published on the website or partner platforms are provided with the utmost care to accurately reflect the services and accommodation offered.

However, minor differences that do not affect the essential characteristics of the property shall not constitute grounds for cancellation or compensation.

Sea views, outdoor facilities, landscaping and ancillary services may evolve over time without affecting the principal purpose of the rental agreement.

12. Force Majeure

Neither party shall be held liable for failure to perform its obligations where such failure results from an unforeseeable, unavoidable and external event as defined under French law.

13. Personal Data

Personal data collected during the booking process is processed in accordance with the website’s Privacy Policy and the General Data Protection Regulation (GDPR).

Guests have the right to access, rectify, erase and object to the processing of their personal data.

14. Complaints

Any complaint relating to a stay must be submitted in writing within a maximum period of 15 days following the end of the stay.

The parties agree to seek an amicable resolution before initiating any legal proceedings.

15. Consumer Mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, guests have the right to use a consumer mediation service free of charge for the amicable resolution of disputes.

After first submitting a written complaint to COSICASA SARL and if no satisfactory solution is reached, the guest may refer the matter to the competent mediator whose contact details are available upon request or published on the website.

16. Acceptance of the Terms and Conditions

Validation of a reservation constitutes full and unconditional acceptance of these General Terms and Conditions of Sale by the guest.

17. Reservations Through Partner Platforms

The villas may be booked directly through the Les Terrasses de Ruppione website or via partner platforms such as Lodgify, Booking.com, Airbnb or Abritel/HomeAway.

Where a reservation is made through a partner platform, the payment, cancellation and refund conditions specific to that platform may also apply.

In the event of any conflict between these Terms and Conditions and the mandatory conditions imposed by the platform used, the platform’s provisions shall prevail solely for matters relating to its intermediary services.
